GCITS (Gulf Coast I.T. Services, LLC) Standard Terms and Conditions

In the event that parts, materials, hardware, software, cables, or supplies are needed, then a nonrefundable full payment is required prior to placing the order.

Your signature on our contract, will signify satisfaction of the services provided and agreement to the GCITS standard terms and conditions. If collection proceedings are initiated by GCITS to collect delinquent amounts, GCITS will be entitled to interest on the outstanding balance plus reasonable attorney’s fees required to collect the outstanding amounts. Failure to pay any outstanding balance shall subject customer to interest charges of 1.5% (one and one half percent) per month until said balance is paid in full. If any balance remains unpaid, all GCITS warranties and guarantees will be cancelled until said balance is paid in full. If invoices are not paid within the agreed to terms, the hourly rate for all unpaid work performed will be re-billed at the hourly rate of $170 per hour. If the bank for any reason returns any form of payment, GCITS will be entitled to bill an additional $40 per incident. In the event of deliberate Credit Card or Check fraud, GCITS will prosecute to the fullest extent of the law.

To protect our investment in our technicians, we will charge you, and you agree to pay for, 2000 hours of regular onsite rate should you hire, or retain as a consultant, our technician prior to the technician having terminated their work with GCITS for one full year. Please be advised that each GCITS technician has signed an agreement, prohibiting them from entering into any employment or contractor relationship with any GCITS customer within the above time parameters.

GCITS will retain 100% (one hundred percent) of the copyrights to any plan, software, or software modifications developed by GCITS and all modules derived from or for the above system. GCITS retains the right to use the plan, software developed, or any routines contained therein for future development or resale. Software developed by GCITS may not be distributed or sold in any form or manner without the express written consent of GCITS.

GCITS disclaims all warranties, expressed or implied, including without limitation implied warranties of merchantability and fitness for particular purpose. Some states do not allow limitations on implied warranties, so this limitation may not apply to you. GCITS does not accept liability beyond the remedies set forth in the GCITS Guarantee below or liability for incidental or consequential damages, including without limitation any liability for products not being available for use or for lost data or software.

GCITS will make every reasonable effort to contact you with questions regarding your repair or service, or to notify you of the completion of your repairs or services using the contact information you have provided and any other means we can devise, which may or may not include USPS Registered Mail, at our discretion. In the event that GCITS cannot notify you of completion of repairs, or move forward with repairs without permission, because you are unreachable by your contact information or any other reasonable means, GCITS retains the right to auction or sell any items, goods, or equipment left at our location or in our possession for more than 30 calendar days.

By signing this document, you agree that you have read and that you understand all Terms and Conditions of doing business with GCITS. This document contains the entire Agreement of the parties and may not be altered or amended except by a written document signed by both parties. If any part(s) and/or section(s) of this Agreement is/are illegal, invalid, or unenforceable according to state law, ALL remaining parts and/or sections of this agreement are and shall remain valid.

Data Loss - GCITS shall make every effort to preserve them, but we cannot be held liable in any way for the loss of your data or software.

System or Component Failure - GCITS cannot be held liable or responsible for the failure of systems or system components while in our care, particularly if and when attempting board-level repair, soldering, or component or card replacement.

It is important to note that systems and components brought to GCITS for repair are or were already in a state of at least partial failure, otherwise there would have been no need to bring them to GCITS for repair. Further failures may be continuations of a logical progression of failure events, stemming from an undiscovered failure point, of which the noted symptoms are merely indicators of further failures to come.

GCITS may, at times, accept from our customers non-working computers and components, in which case it is impossible to determine, before repair, what additional problems may or may not exist. GCITS cannot be held liable for previously undiagnosed failures above and beyond those repaired.

In no event shall GCITS ever be held liable beyond the dollar value of the Service Call in question.
